Medscape Permissions

Medscape is striving for continual improvements in facilitating and granting permissions requests.

We will be developing an online form to use in the near future, but we welcome requests via email.

E-MAIL

Please email permission requests to permissions@medscape.net with the following information in the body of the email:

A. Medscape Material - Detailed information of the Medscape material you wish to reproduce (e.g.: article name or specific excerpts, author or sponsor, and the URL).

B. Usage of Medscape Material - Detailed description of both where and how the Medscape material will be used, including:

FAQ

How long will it take to process my request?

We do our best to turn around permissions within 10 days. In some cases it may take longer.

We do our best to accommodate RUSH requests as we receive them. Any expedited requests, however; should have a RUSH in the subject line and a desired delivery date in the email, so they may be managed accordingly.

Following the permission request instructions will allow us to better expedite your request. We cannot guarantee incomplete requests will be processed in a timely manner. It may be necessary to return incomplete requests for additional information. We appreciate your efforts to include all necessary information regarding your request.

EXCEPTIONS

We currently have some company restrictions on use.

  1. Publishers' Circle/Journal Material: We partner with several medical journals who grant us permission to post their articles on our site. We therefore do not retain copyright; it must be obtained from the publisher. Example found at this link: http://www.medscape.com/viewarticle/563947. This includes Reuter's news articles. If you are unsure, please ask, and we will do our best to route you to the appropriate Rights holder.
  2. CME News/CME Programs: Some of our educational partners help us to develop CME programs for our site. We do not retain the copyright to those programs; it must be obtained from the accrediting body. Example: http://www.medscape.com/viewprogram/6875. However, any programs accredited by Medscape that carry CE or CME credit are ineligible for permission, per our company policy. We do not license our CME programs. Additionally, the CME program must be completed on Medscape to receive proper credit, and we do not currently have a bulk or institutional registration program for obtaining CME or for use of our website.
  3. Electronic Republishing or Reprinting: We do not allow our articles or materials to be reproduced in full on any website. You may link to the article, but may not reproduce the material in its entirety. This also includes reproduction on bulletin boards, in email or electronic newsletters, or other mediums. The only exception applies to educational institutions and their online syllabi, or password-protected websites related to a specific instructor or course, or for internal training purposes.

Our linking policy is as follows: Post the title of the article, author, and a brief summary of the article (or teaser), along with the URL linking to Medscape on your site. Also, include a note after the Medscape link notifying your readers that to view the entire article (and all other content on Medscape), a one-time registration is needed, which is free of charge.

  1. Some Medscape materials, such as our anatomical line drawings, hold external copyright. We are happy to route these requests to the appropriate contact within the company for processing, but keep in mind this may delay your request further.
  2. Fair use: Our fair use policy allows a small amount of material (up to 20 copies) to be used for educational or internal distribution, provided you are including a disclaimer: "Not for distribution. For educational purposes only." If you are in question as to whether your request constitutes fair use, email permissions@medscape.net, and we will be happy to respond.
  3. Using materials in legal proceedings or for regulatory purposes: If approved, authorization must be received from our legal department.
  4. This is not a complete list of exceptions. We do our best to provide a reason if we deny permission, and do our best to accommodate any reasonable request.

Obtaining original graphics, clean copies, bulk reprints, flash and video

In the case of archived material, we may not have the original or high-resolution graphic copies to make available for use. We cannot be responsible for obtaining these on your behalf; however, if we think the author may be able to assist, we can ask the author's permission to be contacted by you to obtain the material. We take our contributors' privacy seriously; we will not give out personal information without consent.

We occasionally receive requests for bulk reprints. If it is on behalf of a commercial entity, it will be routed to our sales department and a fee will be charged.

For educational institutions, we will provide one clean copy to make further copies. Please state the request for a clean copy in the body of your email request.

Unfortunately, we cannot accommodate requests to replicate flash and video at this time. If you have means of capturing these items yourself, please include this information in your request.

FEES FOR USE

Any required fees will be indicated in our reply, and before granting permission will ask you to accept the price quote before issuing the grant letter and invoice.

We encourage Medical Education Companies and other commercial interests to inform Medscape with the intended use of the material and the intended number of copies to be distributed.
